1. Acceptance of Terms
By accessing or using FrontRow ("the Platform"), operated at frontrow.center, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
2. Eligibility
You must be at least 18 years old to use the Platform. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
3. Account Registration
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and all activity that occurs under it. You must notify us immediately of any unauthorized use.
4. Creator Accounts
Creators must complete identity verification through our payment processor before receiving payouts. Creators are responsible for the content they post and must have all necessary rights to distribute it. Creators set their own subscription prices and pay-per-view pricing.
5. Subscriptions and Payments
- Subscriptions are billed monthly on a recurring basis through our payment processor.
- All payments are in USD. Prices are set by individual creators.
- By subscribing, you authorize recurring charges until you cancel.
- Subscriptions are non-refundable. When you subscribe, you receive immediate access to the creator's subscriber-only content. Because digital content is delivered instantly upon purchase, refunds are not available for subscription periods that have already begun.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Pay-per-view (PPV) purchases grant permanent access to the specific content purchased and are non-refundable.
- Tips are voluntary, non-refundable payments sent directly to creators.
6. Content Access and Usage Logging
We log access to paid content, including timestamps, IP addresses, and device information. This data is used to verify legitimate content access, prevent fraud, and respond to payment disputes. By using the Platform, you consent to this logging.
7. Chargebacks and Disputes
Filing a fraudulent chargeback or payment dispute is a violation of these Terms. If you dispute a charge, we may provide evidence of your content access (including login history, content viewed, IP address, and device information) to the payment processor. Accounts associated with fraudulent chargebacks may be permanently suspended.
8. Prohibited Content and Conduct
- Content that exploits, harms, or endangers minors in any way.
- Non-consensual intimate content or content posted without the subject's consent.
- Content that promotes violence, terrorism, or hate speech.
- Downloading, redistributing, or reselling creator content without authorization.
- Using automated tools to scrape, download, or access content.
- Impersonating another person or entity.
- Harassing, threatening, or abusing other users.
- Any activity that violates applicable laws or regulations.
9. Intellectual Property
Creators retain all rights to the content they upload. By posting content, creators grant FrontRow a limited license to display, distribute, and store the content as necessary to operate the Platform. Subscribers and purchasers receive a personal, non-transferable license to view purchased content. No right to download, copy, or redistribute is granted.
10. Platform Fees
FrontRow charges a platform fee on creator earnings from subscriptions, PPV purchases, and tips. The current fee structure is communicated to creators during onboarding. We reserve the right to modify fees with 30 days' notice.
11. Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or receive excessive chargebacks. Users may delete their account at any time through account settings. Active subscriptions will not be refunded upon account termination.
12. Disclaimer of Warranties
The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted access or that the Platform will be error-free. We are not responsible for the content posted by creators or the actions of any users.
13. Limitation of Liability
To the maximum extent permitted by law, FrontRow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to the Platform in the 12 months preceding the claim.
14. Privacy
We collect and process personal data as described in these Terms. This includes email addresses, payment information (processed by our payment provider), content access logs, IP addresses, and device information. We do not sell personal data to third parties. Data is retained as long as your account is active and for a reasonable period afterward for legal and business purposes.
15. Modifications to Terms
We may update these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
16. Anti-Human Trafficking & Content Compliance Policy
16.1 Policy Statement
FrontRow has a zero-tolerance policy for all forms of human trafficking, slavery, and forced labor. We are committed to eradicating the depiction of non-consensual sexual content, child sexual abuse material (CSAM), and any content that promotes or facilitates human trafficking or physical abuse on our platform. We strictly prohibit the use of our services for any illegal activities and demand full compliance from all content creators, users, employees, and partners with all applicable laws and card network rules.
16.2 Prohibited Activities
Any activity related to human trafficking, non-consensual content, or child exploitation is strictly forbidden on our platform. Prohibited activities include, but are not limited to:
- Engaging in, facilitating, or condoning any form of human trafficking or modern slavery.
- Using forced labor or child labor in any aspect of our operations or supply chain.
- Uploading, sharing, or distributing content that depicts non-consensual sexual acts, sexual violence, or physical abuse.
- Uploading, sharing, or distributing child sexual abuse material (CSAM).
- Using our website to advertise, solicit, or provide services that facilitate commercial sex acts involving force, fraud, coercion, or a minor.
- Marketing content in a way that suggests illegal activities, such as child exploitation or non-consensual acts.
16.3 Content and Identity Verification Requirements
We maintain stringent procedures to ensure all content on our platform is legal, consensual, and compliant with card brand standards.
- Age and Identity Verification: We use specialized third-party ID verification services to verify the identity and legal age of all individuals depicted in our content and all individuals who upload content to our platform.
- Documented Consent: Clear, unambiguous, and documented written consent from all individuals depicted in the content is required before publication. This documentation must be readily available for review by our acquirer or card networks upon request.
- Pre-screening and Monitoring: All content is pre-screened and reviewed before publication to ensure compliance. We also actively monitor live-streamed or real-time content to detect and immediately remove any non-compliant material.
- Record Keeping: We maintain records of all identity and consent verification documents and monthly reports of all flagged content, complaints, and actions taken for a minimum required period, as mandated by card network rules.
16.4 Reporting and Takedown Procedures
We provide clear and accessible mechanisms for reporting potentially illegal or non-compliant content.
- Complaint Process: A process is in place that allows for the reporting of content that may be illegal or violates our standards. Complaints can be submitted via support@frontrow.center or by contacting the National Human Trafficking Hotline.
- Prompt Action: Reported complaints are reviewed and resolved within seven (7) business days. If content is found to be non-compliant or illegal, it is removed immediately.
- Appeals Process: Individuals depicted in content have the ability to appeal the removal of content or report content where consent is disputed. Disagreements over consent may be resolved by a neutral third party at the merchant’s expense.
16.5 Consequences of Violation
Any employee, content creator, or user found to be in violation of this policy will face immediate and decisive action, including:
- Immediate removal of all associated content.
- Permanent suspension or termination of their account/employment/contract.
- Reporting of the violation to relevant law enforcement authorities and our financial partners/acquirers.
