18 U.S.C. § 2257 Records Statement

All visual depictions displayed on the FrontRow website, operated by Waavform Labs LLC (the “Website”), whether of actual sexually explicit conduct, simulated sexual conduct, or otherwise, are exempt from the provisions of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 because either (a) the visual depictions do not portray conduct as specifically listed in 18 U.S.C. § 2256(2)(A) parts (i) through (v), or (b) the depictions were created prior to July 3, 1995, or (c) the depictions are otherwise exempt because the visual depictions are not produced, manufactured, published, duplicated, reproduced, or reissued by the Website operator and are therefore not “produced” as that term is defined in 28 C.F.R. § 75.1(c).

With respect to all visual depictions displayed on the Website that fall within the scope of 18 U.S.C. § 2257 and 28 C.F.R. Part 75, the original records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 are kept by the appropriate Content Provider, who is the “producer” (as that term is defined in 28 C.F.R. § 75.1(c)) of the depictions appearing on the Website.

All Content Providers are required, under the FrontRow Content Provider Agreement, to verify the identity and age of every individual depicted in their content using a valid government-issued photo identification, to retain copies of those identification documents and corresponding written consents, and to produce those records to FrontRow or to law enforcement upon valid legal demand.

Records Inspection

Records pertaining to the depictions on the Website are made available for inspection during regular business hours, in accordance with 28 C.F.R. § 75.5, by appointment with the Custodian of Records.
